Implementing Legislation

The Law N° 7399/2024 was published on 23 December 2024. The bill was approved by the Honorable Chamber of Senators on 13 August 2024 and sanctioned by the Honorable Chamber of Deputies on 26 November 2024. This implements Paraguay’s obligations in its entirety under the Singapore Convention on Mediation.

This legislation outlines key aspects of the mediation process, including its initiation, conclusion, and the requirement to maintain confidentiality (Articles 56–60, 62). It also addresses the enforceability of mediation agreements, stipulating that such agreements must be signed by both parties and the mediator and subsequently approved by a competent court to acquire res judicata effect (Article 61).

Furthermore, the law recognizes partial mediation agreements, allowing the settled aspects of a dispute to be excluded from litigation (Article 61). It also regulates the operation of Mediation Centers (Articles 63–64) and sets forth eligibility criteria and ethical guidelines for mediators (Articles 65–67).
